TERMS AND CONDITIONS

PRE-PURCHASE VEHICLE INSPECTIONS

   

Please read the following terms and conditions carefully.  By visiting our website at www.promobileauto.com or ordering an inspection with Promobile Inspections, you agree to be bound by these terms and conditions. The rights and obligations in your agreement with Promobile Inspections are personal to you, and not transferable to another party.​


CANCELLATION POLICY


SAME DAY AND NEXT DAY INSPECTIONS ARE NON-REFUNDABLE


It is the customers responsibility to make the necessary arrangements to ensure the inspected vehicle will be on location and available for the inspection prior to placing your order. Vehicles sold prior to the inspection taking place are not eligible for a refund. If the vehicle is not available for the inspection you will not receive an inspection report. If your vehicle is sold before an inspector is dispatched, your order will be considered “on hold” and you will have a credit for the amount paid which can be applied to another inspection in our service area. A hold expires 30 days from the original purchase date.


CANCELLATION REQUESTS MADE 48 HOURS AHEAD OF YOUR INSPECTION


Cancellation requests made 48 hours ahead of your inspection date will be refunded with a cancellation fee equal to 10% of your total order.

 

If you are eligible and would like to request a cancellation, submit your request including your order number via email to service@promobileauto.com. Eligible refunds will be processed to the card on file within approximately 7-10 business days.



NATURE OF PROMOBILE INSPECTIONS


When you place your order with Promobile Inspections, you are hiring us to evaluate the overall condition of the designated vehicle, based on what our inspectors can objectively observe. Our inspectors do not use jacks or tools or take apart vehicles. The Promobile Inspection service is a visual inspection of all accessible items only, and some issues may not be apparent or observable during the inspection. The inspector will test drive the vehicle, but if this is not feasible, a test drive will not be conducted. Once the inspection is completed, you will receive an email with the inspector's report, along with links to photographic and video media of the vehicle.


SERVICE LIMITED TO INSPECTION


Promobile Inspections performs inspection services only. Promobile Inspections is not responsible for any representations made by the seller or any other party. Inspection is not affiliated with the seller of the vehicle and does not take a position on whether you should, or should not, purchase the vehicle. Promobile Inspections do not verify that the seller has the legal right to sell the vehicle.


INSPECTION IS NOT AN INSURANCE POLICY OR WARRANTY


An inspection does not act as a warranty or as an insurance policy for any vehicle. You acknowledge and agree that if you purchase any vehicle inspected by Promobile Inspections, you are fully responsible for all costs for repairs and maintenance on your vehicle, whether or not covered by any other insurance policy or warranty. You acknowledge and agree that the decision to purchase any vehicle remains your own responsibility and that you are responsible for determining whether a vehicle is under warranty or properly insured.


"AS IS" VEHICLES


Because the vehicle being inspected is a "used" vehicle, you agree that, even after inspection, you will be purchasing the vehicle in an "as is" condition, unless otherwise warranted by the seller. You acknowledge and agree that a Promobile Inspections does not create any warranty for any vehicle you may purchase and that your right to recover for any defects in the vehicle, whether or not disclosed in the Promobile Inspections report, is limited to any warranty the seller may offer.



DISPUTE RESOLUTION


1. Right to Cure

Prior to instituting any proceeding against Promobile Automotive as set forth below, you agree to provide us with a written notice [see paragraph 12] detailing your complaint about our services and giving us at least thirty (30) calendar days to fix the problem.


2. Mediation

Upon expiration of the cure period set forth above, you agree to attempt to resolve any dispute with Promobile Automotive through non-binding mediation. Mediation shall occur at a location of Promobile Automotive’s choosing in Houston, Texas. No other legal or administrative proceedings between you and Promobile Automotive shall be instituted without first attempting to resolve the involved claims through mediation. The parties shall pay their respective costs and expenses of mediation. Your failure to mediate any dispute prior to pursuing any other legal or administrative proceedings will constitute an acknowledgment on your part of a waiver of your claim(s) against Promobile Automotive.


3. Litigation, Applicable Law, and Waivers

You agree that any action relating to this agreement or Promobile Automotive’s services, shall be construed under the laws of the State of Texas, and that any such action shall be instituted and prosecuted in either the federal or state courts located in the County of Harris, State of Texas. Both you and Promobile Automotive waive the right to seek a change of venue. Both you and Promobile Automotive waive the right to a jury trial in any such litigation.


LIMITATION OF LIABILITY 

BECAUSE PROMOBILE AUTOMOTIVE IS NOT THE SELLER OR MANUFACTURER OF THE VEHICLE OR ITS PARTS, AND BECAUSE A PROMOBILE AUTOMOTIVE INSPECTION IS NOT A SUBSTITUTE FOR A MECHANICAL INSPECTION OF THE VEHICLE USING DIAGNOSTIC EQUIPMENT AND TOOLS, YOU AGREE THAT PROMOBILE AUTOMOTIVE’S LIABILITY IS LIMITED TO REFUNDING THE PRICE YOU PAY FOR THE PROMOBILE AUTOMOTIVE INSPECTION IN THE EVENT YOU ARE DISSATISFIED WITH PROMOBILE AUTOMOTIVE’S SERVICE, OR INJURIES OCCUR DUE TO AN UNREPORTED DEFECT IN THE VEHICLE.


OTHER STATE LAWS

Some states do not allow the limitation, exclusion or disclaimer of implied warranties or incidental and consequential damages, so the limitations or disclaimers in this agreement may not apply to you.


SEVERABILITY

If any section of this agreement is found by authorities to be invalid, illegal or unenforceable in any respect and for any reason, the validity, legality and enforceability of the unaffected remainder of such section and the remainder of the agreement shall continue in effect.


THIRD PARTY INSPECTIONS

By purchasing a Promobile Automotive Inspection, you are agreeing that you are purchasing the inspection for your own use and will not resell the inspection to third parties or use the inspection other than for your own evaluation of the vehicle being inspected.





REPAIR WARRANTY INFORMATION


Who is covered and how long does this 12 month 12,000 mile warranty last?


 This 12 month 12,000 mile warranty extends to you as the original purchaser of repairs or maintenance. This warranty does not extend to any person who may purchase your vehicle after the services are performed. This warranty lasts for 12 months or 12,000 miles, whichever comes first, from the date the services are provided and the odometer reading shown on the invoice. Note that any remedial work performed will not restart the warranty period. 


What does this warranty cover?

 

Workmanship, that the services we perform are performed correctly. Promobile Automotive adopts a labor based business model. We pride ourselves on the quality of our services and our mechanics. 


What is not covered by this warranty?

 

Parts installed are warranted as specified by the manufacturer. Failure of parts is not covered under warranty. When we purchase parts it is only by the request of and as a courtesy to our customer. Essentially customers are providing their own parts. We get reimbursed for picking them up and bringing them to the job. As a courtesy to our customers we may at times install a used part provided by the customer understanding that you do so at your own risk. We do not warranty any used part(s).Any issues unrelated to the services ordered by you. For example, if you order a starter replacement because your car was not starting, and the car continues not to start after the starter is replaced, this warranty does not cover the fact that the car does not start. If we did not diagnose the problem then we will not be responsible for the outcome of a misdiagnosed repair. Any pre-existing condition with your car that is not known by us prior to starting the services and that is discovered during or after the services are performed and not as a result of poor workmanship but the aging condition of the vehicle. For example: items made from plastic, spark plug wires, etc.. 


This warranty is entirely void if :


After receiving our services, you take your car to another shop or mechanic with a problem believed to be associated with our services, without giving Promobile Automotive the first opportunity to inspect and remedy the problem. We do not reimburse customers for duplicate or corrective work performed elsewhere. You will be charged for one hour of labor fees at $85.00 per hour if a service call is made under this warranty for an alleged defect determined not to be the result of a defect in the workmanship of the services. You must pay any non-warranty service ordered at the same time as any warranty service.


How do you file a claim under this warranty?


To inquire about obtaining service under this warranty, email us at service@promobileauto.com or call us at 713-545-6826 within the warranty period. When contacting us, please be prepared to describe the nature of the problem and provide proof of purchase, including the work order number. Vehicles must be at the location the repairs were originally made or in our Houston service area when requesting warranty service. We cannot and will not service any vehicle warranty or otherwise on private property (without expressed permission of property owner) or at another service shop. 


Service Agreement Vehicle Repair


Repair and Diagnostic/Estimate Authorization

Customer expressly represents and warrants that customer has the lawful right to authorize repairs

and estimates to be made to the vehicle, whether by right of ownership, leasehold interest, or direct

authorization from the owner of the vehicle. Customer authorizes Promobile Automotive to diagnose

/repair vehicle and to move, test drive or otherwise operate the vehicle for purposes of repairing

the vehicle and determining its functionality. Customer agrees to pay for repairs, parts, fees, taxes,

services and charges which may include towing, parking and/or storage in full at time of service. I

agree that if I should halt repairs for any reason that I will be responsible for the cost of all repairs

completed to that point, as well as the cost of the parts which are not returnable. ProMobile will not

be responsible for loss or damage to vehicle, articles left in the vehicle in case of fire, theft,

accident or any other cause beyond our control. 


Mechanics Lien


I expressly acknowledge a mechanics lien on my vehicle to secure the amount due for service and

repairs. I agree to pay reasonable attorneys fees and court costs in the event legal action is necessary

to enforce this contract.
